Important: Horse riding and equestrian activities involve inherent risk. By booking or taking part, you accept these Terms & Conditions and the risks described below.
1. DefinitionsWe/Us/Our: CW Eventing Coaching Academy & Stud, operating at the address above.
You/Your: the participant (or the parent/guardian if the participant is under 18).
Session: any lesson, hack, clinic, camp, activity day, or other activity we provide.
Premises: our stables, arenas, fields, tracks, parking areas and any location where we deliver sessions.
2. Booking, Prices & Payment
2.1 How to book. Bookings may be made primarily online, but in some circumstances can be made by phone, email or in person. A session is confirmed only when we issue confirmation (including email) and receive any required deposit or full payment.
2.2 Prices. Current prices are shown at the point of booking. We may change prices at any time before you book.
2.3 Deposits & balances. Deposits are non‑refundable unless we cancel the session. Balances are due upfront at the time of booking, but in some circumstances by the date/time stated in your confirmation.
2.4 Vouchers & packages. Vouchers and lesson packages are valid for the stated period from purchase; sessions must be booked and taken within that period.
3. Cancellations, No‑shows & Rescheduling
3.1 Your cancellation, If you need to cancel, please tell us as soon as possible. The following charges apply:48+ hours’ notice: reschedule without fee or refund less any non‑refundable deposit/administration charge. 24-48 hours’ notice: reschedule subject to a fee or 50% charge.Under 24 hours / no‑show / late arrival (15+ mins): 100% charge and no reschedule.
3.2 Leisure services booked for a specific date/time. Where you book a dated Session (including online/phone bookings), statutory “cooling‑off” rights do not apply. We may, at our discretion, allow rescheduling within the rules above.
3.3 Our cancellation. We may cancel or curtail a session for safety, welfare, weather, staff illness, insufficient numbers or events outside our control. You will be offered a reschedule or refund for any unused portion.
3.4 Weather. Riding continues in most weather. In severe conditions (e.g., lightning, high winds, ice), we may modify or stop Sessions for safety; see 3.3.
4. Eligibility, Health & Rider Information
4.1 Accurate information. You must complete our rider registration form honestly and update us of changes (medical conditions, medications, recent injuries, pregnancy, weight, height, experience).
4.2 Fitness to ride. You must be fit to ride and free from any condition that could be aggravated by riding or handling horses. We may refuse participation or adapt activities for safety.
4.3 Weight & age limits. For horse welfare and safety we apply limits: maximum rider weight: 14st; minimum age: 4 years old (unless part of an approved lead‑rein or vaulting programme).
4.4 Alcohol, drugs & conduct. Riding or handling under the influence of alcohol or drugs is prohibited. Abusive or unsafe behaviour may result in removal from the premises without refund.
5. Safety Rules & Equipment
5.1 Instruction. You must follow staff instructions at all times.
5.2 Hats/helmets. A correctly fitted riding hat that meets current accepted standards must be worn while mounted and when leading a horse as directed. Accepted standards include PAS 015:2011 or VG1 01.040 2014‑12, Snell E2016, with a BSI Kitemark or equivalent independent quality mark. Hats with visible damage or poor fit will not be permitted. Hats must be worn when handling the horses under all circumstances.
5.3 Footwear & clothing. Wear sturdy, smooth‑soled boots or wellies with a small heel; no trainers, sandals for mounted activities and on the yard at all times. Wear long trousers and gloves; remove jewellery; tie back long hair. Body protectors may be required for jumping, cross‑country or as directed.
5.4 Our horses & tack. Do not feed horses or adjust tack without permission. Report any issues immediately.
5.5 Lead‑rein & supervision. Children and new riders may be required to ride on the lead‑rein or with a leader. Spectators (including parents) must follow staff directions and remain in designated areas.
5.6 Dogs & visitors. Dogs are not permitted on site under any circumstances. Visitors are welcome but must follow staff directions.
6. Your Acknowledgement of Risk
6.1 Inherent risk. Horses are living animals that may react unpredictably. Risks include, without limitation, falls, kicks, bites, being stood on, collisions, and environmental hazards.
6.2 Your responsibility. You accept these inherent risks and agree to ride sensibly, within your ability and the instruction given, and to use appropriate protective equipment.
6.3 Animals Act 1971. Nothing in these Terms seeks to exclude any liability arising under applicable law, including the Animals Act 1971, where we are legally responsible.
6.4 I acknowledge that riding is a risk sport and holds a potential danger, and that all horses are unpredictable. I understand that I must obey the instructions of the instructor and must comply with the health & safety requirements of the establishment.
6.5 I acknowledge that I reserve the right not to ride a horse allocated to me and request a change of instructor. 6.6 Data Protection Act 1998: Statement: I understand that the information I have provided will be held in accordance with the Data Protection Act 1998 but may also be available to Insurers and other parties in the event of an injury or accident.
7. Our Duty of Care & Liability
7.1 Reasonable care and skill. We will provide our services with reasonable care and skill and take reasonable steps to ensure the premises and equipment are safe for the intended use.
7.2 What we do not exclude. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
7.3 What we may limit. Subject to 7.2, our liability for loss or damage that is not foreseeable or not caused by our breach, and for loss of business, profit or consequential loss, is excluded to the fullest extent permitted by law.
7.4 Personal property. Vehicles and belongings are left at your risk. We recommend removing valuables and keeping car doors locked.
7.5 Insurance. We maintain appropriate public liability and employers’ liability insurance as required by law; certificates are available for inspection on request.
8. Safeguarding (Children & Adults at Risk)
8.1 We are committed to a safe, inclusive environment and follow recognised equestrian safeguarding policies and procedures.
8.2 All staff and volunteers working with children undergo appropriate safer‑recruitment checks (including DBS where required) and training.
8.3 If you have a safeguarding concern, report it immediately to our Safeguarding Lead: Chris Wincer & Richard Dixon or to the relevant authority. In an emergency, call 999.
9. Incidents & Reporting
9.1 Accidents and near misses must be reported to staff immediately and recorded in our accident book.
9.2 We will notify relevant authorities where required by law (e.g., RIDDOR) and will cooperate with any investigation.
9.3 You agree to provide accurate contact details for follow‑up if needed.
10. Data Protection & Privacy
10.1 We process personal data in accordance with UK data‑protection law. Our Privacy Notice explains what we collect, why, legal bases, how long we keep data, and your rights.
10.2 Photography/filming. We will seek consent before using identifiable images for marketing. You may withdraw consent at any time. Please do not photograph others without their consent.
10.3 CCTV. Where CCTV operates on site, signage is displayed and footage is processed for safety and security purposes in line with our Privacy Notice.
11. Gift Vouchers, Lessons Packs & Clinics
11.1 Vouchers are valid until the expiry date stated and are non‑refundable once issued, except where required by law.
11.2 Clinics/camps may have specific entry conditions (e.g., minimum ability, protective equipment) which form part of these Terms.
12. Complaints
12.1 Please raise any issue with your instructor or at the office promptly so we can resolve it.
12.2 If unresolved, email cwincer@hotmail.co.uk. We aim to respond within 10 working days.
12.3 If you remain dissatisfied, you may seek advice from Trading Standards or an alternative dispute resolution (ADR) body. Use of ADR is voluntary unless required by law.
13. Changes to Terms
We may amend these Terms for legal, regulatory or operational reasons. Updated Terms will be posted on our website and available at reception. Changes will not affect Sessions already booked unless required by law or for safety.
14. Governing Law
These Terms and any dispute or claim (including non‑contractual disputes) are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales. For consumer disputes, you may also bring proceedings in your local UK court if different.
